The Director - Trials and Investigations is responsible for directing the disciplinary process with the primary responsibility of overseeing the disciplinary investigations and trials required by the collective bargaining agreements and Long Island Rail Road’s policies and procedures. This position reports and provides support to the Deputy Chief Labor Relations Officer, directly supervises the professional staff within the unit and monitors all activities that fall within the jurisdiction of this department.
Responsibilities may include but are not limited to:
-Oversee and manage the disciplinary process with the primary responsibility of issuing charges, executing waiver agreements and ensuring the disciplinary investigations and trial process is performed as required by the collective bargaining agreements and in furtherance of the LIRR’s labor management objectives.
-Maintain good working relationship with union representatives on a day-to-day basis. Deal with all day-to-day disputes that arise with unions regarding disciplinary action.
-Interact with senior management and senior union officials to resolve labor disputes. Work closely with all departments on following and improving the investigatory and disciplinary processes. Effectively manage and coordinate the workflow of the investigative process. Quickly identify problem areas in the workflow process and develop efficient remedies.
-Prepare long-range Labor Relations plans in terms of target goals over ten-year periods together with the tactical approaches for achieving such goals.
-Provide counsel and assistance on legal matters involving labor relations issues. In the absence of the Deputy Chief Labor Relations Officer, the position includes the responsibility of spokesperson.
-Select, develop and motivate personnel within the department. Provide career development for subordinates. Provide prompt and effective coaching and counseling. Responsible for discipline/termination of employees when necessary. Review direct reports and approve performance appraisals. Promote safe work practices and provide safe working conditions. Create a professional environment that respects individual differences and enables all employees to develop and contribute to their full potential.
-Ensure a safe working environment and adherence to guidelines of company safety policies and procedures. Lead by example.
-Perform other assignments as requested by Senior Management.
-Must possess a Bachelor’s Degree in Labor Relations, Human Resources, or related field.
-Minimum of ten (10) years of experience handling disciplinary trials, investigations and dispute resolution in a multi-union environment.
-Minimum of eight (8) to ten (10) years of experience supervising others.
-Must know the Railway Labor Act and its interpretation by the courts.
-Must have effective communication, writing, presentation, critical thinking/problem solving, decision-making, and negotiations skills.
-Must be able to manage conflict, resolve labor disputes and effectively ensure consistent application of collective bargaining agreements and discipline.
-Must have the knowledge and flexibility to handle a number of diverse issues occurring simultaneously.
-Must have strong leadership skills with the ability to develop, motivate, mentor and foster teamwork.
-Ability to exercise a reasonable level of independent judgment and decision making.
In addition to meeting the minimum requirements of the position, the selection process may include, but is not limited to, a pre-screening assessment (i.e., physical, written and/ or practical evaluation) and interview. In addition, LIRR employee applicants must be in their current position for the 12 months immediately preceding the close date of this posting and must possess a satisfactory work history, including attendance and discipline record. Absence control violation(s) or more than ten sick days without medical documentation in two of last three years is considered unsatisfactory attendance.
